Privacy Statement

For Orica-Nitro, protecting your personal data is both an objective and a responsibility. We therefore put technical and organisational measures into practice to protect your data in accordance with the Labour Law No. 4857 and the Electronic Communications Act. The Data Protection Policy below aims to inform you how we handle the collection, processing, use and forwarding of your personal data.

1. Collection and processing of data

The nature of the personal data we save about you depends on how you use our website and communicate with us.

In general, you can visit our website without leaving personal data, e.g. if you want to find out about our products and access the relevant pages. This kind of access to our website and any access to any files saved on the website is logged by our Internet Service Provider (ISP). This information is saved internally within the system for statistical purposes. The log records: name of file accessed, date and time of access, data volume transferred, record of successful access, web browser and initiating domain. Orica does not use this data to identify users based on their internet activities.

In the unlikely event of an investigation, criminal investigation authorities or other government bodies can view our ISP logs or personal data we have stored.

It is also possible that your own ISP logs your internet activities while you are visiting our website. But this is obviously something we cannot influence.

While you are visiting our website, we only save information about you if you voluntarily supply us with personal or business information.

Personal data is data which contains information on your identity. This includes, for example, information such as name, address, telephone number, date of birth and email address.

You can sign up for the “Inner Circle”. For this, we need the following information from you: surname, first name, occupation, address, your email address and a password of your choice. Pressing the "Apply" button saves your data to our database. Following registration and an authorisation confirmation from Orica for the "Inner Circle", you will automatically receive an email confirming your registration. The email address you give and the password selected also serve as a username for the "Inner Circle". You can amend your data within your customer account at any time. The username and password must be kept secret and must not be divulged to third parties.

2. Purpose, use and disclosure of personal information

The personal information you provide us with during your visit to this website or during other interaction with us is used to provide you with a better service in terms of delivering our products and services. The information we receive from your use of our website allows us to tailor products and services better to your requirements.

Orica does not sell or trade your personal data.

All personal or business information you provide to us is used only internally at Orica and not divulged to third parties, unless third parties absolutely require this information for the purpose for which you gave the information to us. For example, freight forwarders and delivery companies are given the information they require to make deliveries.

We only divulge personal data about you if we are obliged by law or by a legal ruling or when disclosure is required to implement or protect or General Terms and Conditions of Business or other agreements. This applies in particular to the storage of data.

Our employees and the service companies we commission are bound to confidentiality and compliance with the regulations of the Labour Law. Access to personal data by our employees is restricted to the employees who need to access the data to fulfil their roles.

We only save your email address for the purpose for which you provided it to use and it will not be added to a mailing list or used for another purpose without your consent.

If you provide us with your personal data for access to the "Inner Circle", Orica may also use your personal data for the purpose of direct marketing. However, we can only use your personal information or data for direct advertising if it is not practically possible to obtain your explicit consent in advance. But if we do this, we will give you the opportunity to decline to receive further marketing communications when we contact you for the first time.

During your visit to our website, we would like to save cookies to make it easier for you to use our website.

Cookies are small text files which are stored on your hard drive or another storage medium (permanent cookies) or in temporary memory (session cookies). Cookies help us extend our web services and optimise your online experience.

Permanent cookies identify the pages you have accessed and store personalised functions, e.g. the page you wish to make your start page. They help us design and lay out our website, improve applications and measure their effectiveness.

Session cookies are used for security purposes and in order to maintain continuity within your browser session. These cookies allow us to recognise you automatically next time you visit our website, make our offer more user-friendly and make navigation easier. They can also be used to save your password so you do not need to re-enter it every time.

When you visit our website, you are asked to consent to cookies being saved. If you do not wish us to remember your computer and store cookies on your hard drive, you will not be able to enjoy the full functionality of our website.

The website uses Google Analytics, an internet evaluation service from Google Inc. ("Google"). Google Analytics uses what are known as "cookies" - these are text files which are stored on your computer to enable an analysis of your use of our website.

The information generated by the cookie about your use of this website is generally transferred to a Google server in the USA and saved. If IP anonymisation is activated on this website, your IP address is first truncated within member states of the European Union or other signatory states to the agreement on the European Economic Area. Only in exceptional circumstances is the full address sent to a Google server in the USA and then truncated. On behalf of Orica, Google uses this information to evaluate your use of the website, to prepare reports of website activities and to provide other services associated with website and internet usage for Orica.

The IP address transferred by your browser to Google Analytics is not amalgamated with any other Google data. You can prevent cookies being saved by changing a setting in your browser software, but please be aware that this may mean you are not able to use all the website functions to their full extent. You can also prevent the recording of the data generated by the cookie relating to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing the browser plug-in from the link below. The current link is https://tools.google.com/dlpage/gaoptout?hl=en.

More information on this can be found at https://tools.google.com/dlpage/gaoptout?hl=en and http://www.google.com/intl/en_uk/analytics/privacyoverview.html (general information on Google Analytics and data protection). We would like to point out that the code "gat._anonymizeIp();" has been added to Google Analytics on this page to allow anonymised recording of IP addresses (known as IP masking).

If you wish to use social media services (e.g. Facebook, Twitter, Google+ and other providers), you can click on the relevant buttons provided by the operators of these platforms for this purpose.

The fact that these buttons are embedded into our website means that data is normally sent to Twitter, Facebook and Google+ automatically without website users explicitly consenting to this. Besides the web address of the site visited, a code is also transmitted which enables a direct link between the website visitor and their profile on, for example, Facebook. The platforms do not provide specific information on what other information is transmitted. We recommend that you read the relevant privacy policies of these providers and their websites.

3. Security of your personal data

We have taken all reasonable measures to ensure that your personal data that we store, process or divulge is stored in a secure environment which can only be accessed by authorised persons.

Although Orica utilises advanced data encryption methods when communicating with customers, suppliers and other partners, visitors to our website should be aware that there is some residual risk in any electronic transfer. This risk applies to the whole internet.

We are also unable to guarantee complete data security when communicating by email and would recommend conventional mail for confidential information.

4. Links

If you click on external links from within our internet pages, the Data Protection Policy does not cover these links.

If we provide links to other websites, we make every effort to ensure that they also comply with our data protection and security standards. However, we have no influence over compliance with data protection and security standards by other providers. Therefore, we would recommend you consult the privacy policies provided on the websites of these other providers.

5. Information

In accordance with Articles 75 of the Labour Law, on receipt of a written request, we are happy to inform you about the data we hold about you and for what purpose we have recorded it. Please use the contact address provided in the legal information section for this.

6. Correcting / Updating your personal data

We have taken all reasonable measures to ensure that the information we collect, save, process or divulge is correct, complete and up-to-date. Please contact us if you wish to change your data or if you believe that the information we have about you is incorrect or incomplete.

7. Right to cancel / delete

You can cancel the use and processing of your data in writing at any time. We will then delete your data unless there are statutory retention regulations which prevent us deleting it, in which case we will lock it instead of deleting it.

The personal data we have stored shall also be deleted automatically if it is no longer required to fulfil the purpose for which it was saved or if storing it is unauthorised for another legal reason, unless the statutory retention regulations prevent us deleting it, in which case we will lock it instead of deleting it.

8. Changes to our Data Protection Policy

We reserve the right to amend our security and data protection measures if this is made necessary by technical developments. In this case, we will also amend our Data Protection Policy accordingly. Please make sure you are referring to the latest version of the Data Protection Policy at all times.
